1. Conclusion of the Contract

The presentation of the products in the app is not a legally binding offer, but a non-binding product catalogue. By clicking on the button "Order now for a fee" you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after sending the order and does not constitute an acceptance of the contract. We can accept your order by sending an order confirmation by e-mail or by delivering the goods within two days.

2nd cancellation policy


Right of withdrawal

You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took or has taken possession of the last goods.

In order to exercise your right of revocation, you must notify us (mhero GmbH, Pragerstraße 2b, 01069 Dresden, E-Mail: [email protected] by means of a clear statement (e.g. a letter, fax or e-mail sent by post) about your decision to revoke this contract. You may use the attached model revocation form for this purpose, but this is not mandatory.

In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.

Consequences of revocation

If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (other than any additional charges arising from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date on which we receive notice of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to make any refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return the goods to us or hand them over to Hermes without delay and in any event within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. This period shall be deemed to have been observed if you dispatch the goods before the expiry of the fourteen-day period.

We bear the costs of returning the goods.

You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary for the purpose of checking their nature, properties and functioning.

3. exclusion/cancellation of the right of withdrawal


According to § 312g Abs. 2 BGB a right of revocation does not exist among others for contracts for the delivery of goods which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer and it expires prematurely for contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery

4.delivery

Deliveries are generally possible within Germany, Austria and Switzerland. The delivery of articles is only possible in quantities customary in households and only to end consumers. The costs of shipping are transferred to the customer as indicated. Any costs arising from customs regulations are also to be borne by the buyer.

5. warranty

If delivered articles should have obvious material or manufacturing defects, including transport damage, please complain about such defects immediately to us or to the employee of the transport service provider who delivers the articles. Failure to do so, however, will not have any consequences for your legal claims. For all defects of the purchased goods occurring during the legal warranty period, the legal claims for supplementary performance, for removal of defects/new delivery as well as - if the legal requirements are met - the further claims for reduction or withdrawal as well as compensation for damages, including compensation for the damage instead of performance as well as compensation for your futile expenses, shall apply at your choice.

6. shipping costs

The shipping costs are to be paid according to the marking in the app shop.

7. payment

The payment can be made with the payment methods prepayment, credit card, invoice and Paypal. We reserve the right not to offer certain payment methods and to refer to other payment methods for each order. Please note that we only accept payments from accounts within the European Union (EU). In the case of credit card purchases, your credit card account will be charged when we send the order. In case of purchase on account, you will be informed about the due date of the purchase price on the order overview page before conclusion of the contract. You agree that you will receive invoices and credit notes exclusively in electronic form.
In selected cases it is also possible to purchase the goods against stars or vouchers received in the app. We always offer special offer vouchers. Promotional vouchers are vouchers which you cannot purchase, but which we issue as part of advertising campaigns with a certain period of validity. Please note that different terms and conditions may apply to promotion vouchers. Furthermore, promotion vouchers are not redeemable with all sales models.


Payment via Paypal

You pay directly via your PayPal account. After submitting your order you will be forwarded to PayPal and release the order value there. As soon as our PayPal account has been informed about your authorization, the shipment will take place - depending on the delivery time indicated at the article. When the goods are shipped, your PayPal account will be debited with the actual invoice amount after deduction of any discounts, gift vouchers, etc. For goods that are specially made to customer specifications or clearly tailored to personal needs, your PayPal account will be immediately debited with the actual invoice amount after deduction of any discounts, gift certificates, etc.


Coupons and promotion codes

Promotional vouchers are vouchers that cannot be purchased, but which we issue as part of advertising campaigns with a certain period of validity. In certain cases, they can also be purchased against stars or within the lottery.

Promotional vouchers can only be redeemed within the specified period and only once during an order process. Individual stamps may be excluded from the voucher promotion. The promotion voucher cannot be transferred to third parties. Several promotion vouchers cannot be combined with each other, unless we have agreed otherwise.

8. Awards

Our prices are Euro prices and include the legal value added tax.

9. retention of title

The goods remain our property until full payment has been received.

10th Electronic Communication

You agree that contract-related communication may be made in electronic form.

11. Alternative Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12th Contract Language/Saving the Order Text

The contract shall be concluded in the German language. The order text is not stored by us and cannot be retrieved after completion of the order process. However, you can print out your order data immediately after sending the order.
